Terms of Service

These Terms govern your use of Twindevs products, the Twindevs portal, and this website (together, the “Service”). By using the Service, you agree to these Terms.

1. Eligibility & accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. You are responsible for the activity under your account and for keeping your credentials secure. Provide accurate information and keep it current.

2. The Service

Twindevs provides privacy-first software including TwinMail, TwinContacts, TwinVault, TwinHermes, and TwinSystem, plus an account portal. Some features are local-first and run on your device; optional cloud features are disclosed and require your explicit consent.

3. Messaging program terms (SMS)

If you opt in, Twindevs sends recurring transactional and account text messages under the program “Twindevs Account & Service Notifications.” By opting in (at signup or in your portal settings), you agree to the following:

  • Message types: verification codes (2FA), account notifications, message/proposal alerts, billing updates, service-status alerts, and maintenance notices.
  • Frequency: recurring; the number of messages depends on your account activity and settings.
  • Cost: Message & data rates may apply. Twindevs does not charge for the messages; your mobile carrier’s rates apply.
  • Opt-out: reply STOP (or UNSUBSCRIBE, CANCEL, END, QUIT, STOPALL) at any time, or turn off SMS in your portal settings. Reply HELP for help.
  • Carriers: mobile carriers are not liable for delayed or undelivered messages.
  • Consent records: your opt-in and opt-out decisions are logged as immutable, timestamped events.

4. Acceptable use

You agree not to misuse the Service, including by: attempting to breach security or access data without authorization; using the Service to send unlawful, infringing, or abusive content; interfering with or disrupting the Service; or using it to violate any applicable law, including telecommunications and anti-spam laws.

5. Your content

You retain ownership of the content you submit. You grant Twindevs the limited rights needed to operate the Service (such as storing and transmitting your content to provide notifications you requested). You are responsible for the content you submit and the consents you assert.

6. Intellectual property

The Twindevs name, logos, software, and site content are owned by Twindevs or its licensors and are protected by intellectual-property laws. These Terms do not grant you any right to our trademarks or branding.

7. Third-party services

The Service relies on third-party providers (for example, Twilio for SMS, an email delivery provider, and hosting infrastructure). Their availability and terms may affect the Service, and we are not responsible for third-party services outside our control.

8. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

9. Limitation of liability

To the maximum extent permitted by law, Twindevs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or revenue, arising out of or related to your use of the Service.

10. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or to protect the Service or its users. Certain provisions (such as intellectual property, disclaimers, and limitation of liability) survive termination.

11. Changes to these Terms

We may update these Terms from time to time. We will revise the “Last updated” date and, for material changes, provide additional notice where appropriate. Continued use after changes means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules.
